DELIVERY
1. DELIVERY TERMS
Delivery shall be made Ex Works (EXW) the ROCES warehouse (incoterms 2020). The products shall travel at the risk of the customer, who must therefore take out any necessary insurance. ROCES shall not be held liable for any damage of any kind that may occur to the products during transport. The customer is solely responsible for the choice of the carrier and shall bear all related costs. The delivery times communicated by ROCES are provided for information purposes only and are not binding. Failure to meet these indicated times shall not give rise to any compensation or right to cancel the order.
2. DELIVERY DELAYS AND FORCE MAJEURE
ROCES shall not be held responsible for any delay in delivery or failure to deliver resulting from a case of force majeure. Cases of force majeure include, but are not limited to: wars, riots, fires, strikes, accidents, epidemics, pandemics, health crises, restrictions on transport, energy shortages, lockouts, governmental or legal restrictions, natural disasters, adverse weather conditions, failures or interruptions of telecommunications or network infrastructure, and any other circumstances beyond the control of ROCES that prevent, hinder, or delay the fulfillment of its obligations. In such events, ROCES’ obligations shall be suspended for the entire duration of the force majeure event. If the force majeure event persists for more than sixty (60) consecutive days, either party shall have the right to terminate the affected order(s) by written notice, without either party being able to claim any compensation.
3. RECEIPT OF PRODUCTS AND CLAIMS
The customer must verify the condition of the products upon receipt. Any claim for visible damage, non-conformity, or missing items must be indicated in writing on the carrier’s delivery slip at the time of delivery and must also be confirmed in writing to the carrier and to ROCES within three (3) calendar days of delivery. For any hidden defects not discoverable during a diligent inspection upon delivery, the customer must notify ROCES in writing within a maximum of eight (8) calendar days from the date of discovery of the defect. Failure to comply with these deadlines for notification shall result in the irrevocable acceptance of the products by the customer, who may no longer make any claim for the reported issues. All claims must be sent in writing. The customer must provide all necessary evidence to support the claim (photographs, detailed description, etc.). ROCES reserves the right to inspect the products concerned before making any decision.
4. RETURNS
No returns of products will be accepted without the prior written authorization of ROCES. Any unauthorized return will be refused and returned to the sender at the sender’s expense. The return of products must be carried out in accordance with the specific instructions provided by ROCES. The products must be returned in their original packaging, in perfect condition, and with all accessories. Return shipping costs are the responsibility of the customer, unless otherwise agreed in writing by ROCES. A restocking fee may be applied.
